Terms and Conditions - Aero Models

  1. Definitions
  • Entrepreneur: Aero Models, established in Krommenie, registered with the Chamber of Commerce under number 98267361.
  • Customer: any natural or legal person who enters into an agreement with the entrepreneur.
  • Agreement: the purchase agreement between entrepreneur and customer regarding custom products to be delivered by entrepreneur.

 

  1. Applicability

These terms and conditions apply to all offers, orders and contracts established through the web store of Aero Models.

 

  1. Establishment of the agreement
  • The agreement is established when the customer places an order and the entrepreneur confirms it.
  • Because these are products that are custom-made or made to the customer's specifications, the agreement is binding after confirmationbindingand cannot be revoked free of charge.

 

  1. Payment
  • Payment must be made in two installments using the payment methods offered in the invoice.
  • After the initial payment, the order is processed and production begins.
  • The order will not be delivered until full payment is received by the entrepreneur.

 

  1. Prices and price changes
  • All prices include VAT and exclude any shipping costs unless otherwise stated.
  • Prices are subject to change in the interim. For already confirmed orders, the price valid at the time of ordering always applies.

 

  1. Delivery
  • Delivery will be made to the address provided by the customer.
  • The entrepreneur will comply with the agreed delivery period as much as possible, but this period is indicative.
  • Exceeding the delivery period does not entitle the customer to compensation or dissolution of the contract, unless there is intent or gross negligence on the part of the entrepreneur.

 

  1. Warranty
  • The entrepreneur guarantees that the delivered products comply with the agreement and do not have any defects that hinder normal use.
  • Warranty does not apply to defects caused by improper use, normal wear and tear, or modifications made by the customer himself.

 

  1. Liability
  • The entrepreneur is not liable for damages resulting from improper use of the products.
  • Any liability of the entrepreneur is limited to the amount of the order in question.

 

  1. Right of withdrawal and returns
  • Pursuant to Article 6:230p sub f of the Civil Code, there isno right of withdrawalfor products manufactured according to customer specifications or clearly personal in nature.
  • Therefore, returns are not possible unless the product was delivered defectively or does not conform to the agreements made.

 

  1. Complaint Procedure
  • Complaints about the execution of the agreement must be submitted to the entrepreneur by e-mail, fully and clearly described, within 7 days of discovery.
  • The entrepreneur will respond substantively within 14 days of receiving the complaint.
  • If the complaint cannot be resolved by mutual agreement, the customer may submit the dispute to a competent court in the Netherlands.

 

  1. Applicable law

All agreements are governed by Dutch law.
